RE: The tariff classification of anchor wire and bent log wire from China.

Dear Mr. Hillegeist:

In your letter received on September 18, 2008 you requested a tariff classification ruling on behalf of Mi-Lar Fence Company Inc. Samples and illustrations were submitted.

The items you plan to import are described as anchor wire, product number W500148, and bent log wire, product number W3425090. The cold drawn galvanized anchor wire is made of carbon steel and measures 5 inches in length with a diameter of 0.148 inches. You indicate that this wire acts like a stake and will be used to hold garden edging in place.

The bent log wire is used to hold split logs together to form a garden border. This cold drawn galvanized carbon steel wire measures approximately 70 inches in length with a diameter of 0.090 inches. Prior to importation the wire has been bent by hand to form an elongated rectangular ā€œCā€ shape with the two arms of the ā€œCā€ 2.5 inches apart and extending for 34 inches.

You suggest classification of the anchor wire and bent log wire under subheading 7326.20.0070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel wire. However, based on the information submitted the items in question are more specifically provided for in heading 7215, HTSUS.

The applicable subheading for the anchor wire and the bent log wire will be 7215.90.3000, HTSUS, which provides for other bars and rods of iron or nonalloy steel, other, plated or coated with metal, cold-formed. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
